§ 15-62. Weight restrictions upon certain streets.

(a)

Operation, movement, and parking of certain motor vehicles restricted. The operation, movement, and parking upon the streets, roads and alleys of Henrietta, Texas of motor vehicles exceeding the following weight and length restrictions is hereby prohibited.

Vehicles exceeding the gross vehicles weight of fifteen thousand (15,000) pounds when empty, in accordance with manufacturers weight specifications; or vehicles in combination with a trailer that exceed the gross vehicle weight of fifteen thousand (15,000) pounds and are in excess of twenty-one (21) feet in length.

(b)

Exemptions. The following motor vehicles shall be exempt from enforcement of this article.

(1)

Motor vehicles that provide essential services related to the health, safety and welfare of the citizens and the general public (i.e. ambulances, sanitation trucks, fire trucks, etc.)

(2)

Vehicles that must travel over certain streets, roads or alleys to provide services necessary to sustain the private property rights of the citizens of Henrietta (i.e. construction vehicles engaged in a specific project within the city limits, vehicles involved in repairing or improving private property, or service vehicles such as water or sewer vehicles and equipment, street department vehicles and equipment, franchised public vehicles and equipment and the like);

Vehicles whose owner or operators have requested and received permission from the sheriff or deputy sheriff acting in his or her capacity as an official law enforcement officer of the City of Henrietta and Clay County for the temporary operation or movement of vehicles exceeding the weight restrictions.

(c)

Exception. This article is not enforceable upon streets or roads that are also designated as farm to market roads, state highways and the like for the operation and movement of vehicles that exceed the weight restriction; parking on such streets or roads that impedes, endangers, or restricts the flow of traffic is prohibited (i.e. Highway 287, Highway 82, Highway 148 South, Highway 148 North, Spur 510, Farm Road 1197).
