§ 20-23. Removal and disposal regulations.

  • (a)

    Restrictions on disposal of garbage and other waste material. It shall be unlawful for any person engaged in the removal, handling, transfer, or in any manner dealing with garbage, rubbish, manure, refuse or other waste matter, whether in person, or by his, her or its agent, employee or servant, to separate, unload, offer for sale or trade or exchange all or any part of such garbage, rubbish, waste, manure, refuse or other waste material, within the jurisdiction of the city, except at places designated by and in compliance with the ordinances and code of the city relating thereto.

    (b)

    Removal permit required. Any person engaged in the removal of garbage, rags, refuse matter, manure or waste material of any kind within the jurisdiction of the city shall, before engaging in such work, obtain a permit from the director of public health of the city to do so, which permit, if granted, shall be issued by the director of public health upon receipt of payment of a license fee of twenty-five dollars ($25.00) per year. Such license fee shall be paid to the assessor and collector of taxes of the city before the permit is issued by the director of public health and shall be renewable yearly. It shall be unlawful for any person who has not secured such permit, to engage in such business or to remove from any garbage containers, box, barrel, can or other receptacle provided for the deposit of garbage or other waste material, any garbage, rags, refuse matter, manure or waste material of any kind, or to in any manner interfere with any such container or receptacle; provided, further, however, that, no license issued to any junk dealer of the city shall authorize any person to whom such license is issued to remove any such waste material from any container or receptacle, or in any manner interfere with any such container or receptacle. Each person so issued a permit shall cause each cart, wagon, truck or vehicle used in removal of garbage, rags, refuse matter, manure or waste material of any kind to be provided with a number corresponding with the permit so issued. The letters shall be legible from either side of the vehicle and shall bear the following inscription: D.H.D. No. _______. All letters shall be four (4) inches high and painted or stenciled upon the sides of the vehicles. This vehicle shall be inspected and approved by the director of public health before being used to haul garbage, rags, refuse matter, manure or waste material of any kind.
