§ 23-51. Public sites and open spaces.
(a)
The subdivider shall give consideration to suitable sites for schools, parks, playgrounds and other areas for public use so as to conform with the recommendations of the council. Any provision for schools, parks, etc., shall be indicated on the preliminary plat.
(b)
No individual, partnership, firm or corporation shall deepen, width, fill, reroute or change the course or location of any existing ditch, channel, stream or drainageway, without first obtaining written permission of the city or other agency having jurisdiction.
(c)
In cases where a subdivision contains or abuts a school, parks, or playground, the subdivider shall dedicate one-half of a normal residential street, twenty-five (25) feet, and provide for one-half of the cost of paving and the full cost of all the utilities necessary. The interested agency shall provide the necessary right-of-way to make the street sixty (60) feet in width (which is thirty-five (35) feet) and provide one-half of the cost of the paving.
