§ 3-1. Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meaning ascribed to them herein, except where the context clearly indicates a different meaning:
Alcohol beverage permit shall mean an official certificate issued by the city secretary certifying compliance with this chapter.
Alcoholic beverage means alcohol or any beverage containing more than one-half of one (½) percent of alcohol by volume which is capable of use for beverages purposes either alone or when diluted.
Ale or malt liquor means a malt beverage containing more than four (4) percent of alcohol by weight.
Beer means a malt beverage containing one-half of one (½) percent or more of alcohol by volume and not more than four (4) percent of alcohol by weight and does not include a beverage designated by label or otherwise by a name other than beer.
Licensee means a person who is the holder of a license provided in this ordinance, or any agent, servant, or employee of that person.
Mixed beverages means one (1) or more servings of a beverage composed in whole or part of an alcoholic beverage in a sealed or unsealed container of any legal size for consumption on the premises where served or sold by the holder of a mixed beverage permit.
Permittee means a person who is the holder of a permit provided for in this chapter, or an agent, servant, or employee of that person.
Private school means a private school including a parochial school that (1) offers a course of instruction for students in one (1) or more grades from kindergarten through grade 12 and (2) has more than one hundred (100) students enrolled and attending courses at a single location.
Residential area means, (a) an area in which the actual land use is predominantly one of private residences; (b) a subdivision for which a plat is recorded in the real property records of the county and that contains or is bounded by public streets or parts of public streets that are abutted by residential property occupying at least seventy-five (75) percent of the footage along the block face; and/or; (c) a subdivision for which a plat is recorded in the real property records of the county and a majority of the lots of which are subject to deed restrictions limiting the lots to residential use.
Wine and vinous liquor means the product (or libation) obtained from the alcoholic fermentation of juice of sound ripe grapes, fruits, berries or honey, and includes wine coolers.
