§ 3-8. Variance for alcohol sales.

  • (a)

    The city council may allow a variance to section 3-7 if it determines that the enforcement of the regulation in a particular instance:

    (1)

    Is not in the best interests of the public;

    (2)

    Constitutes waste or inefficient use of land or other resources;

    (3)

    Creates an undue hardship on the applicant for a license or permit;

    (4)

    Does not serve its intended purpose, is not effective or necessary; or

    (5)

    Would be inequitable because a previous permit was issued for the premises in error.

    (b)

    The city council may allow a variance to section 3-7 for any other reason the city council determines, after consideration of the health, safety and welfare of the public and the equities of the situation, that the variance is in the best interest of the community.
