§ 4-5. Impoundment, sale and disposal of livestock running at large.

  • (a)

    Any horses, shetland ponies, mules and donkeys, sheep, goats, cows, and similar animals running at large within the city shall be subject to impoundment and destruction by the city, and any horses, shetland ponies, mules, donkeys, sheep, goats, cows, and similar animals impounded by the city shall be subject to sale by the city for the purposes of repaying the city for the expense of impounding and keeping the same, and the city animal control officer is authorized and it is made his duty to impound, catch and restrain from their liberty, destroy and otherwise prevent the running at large of any horses, ponies, mules, donkeys, sheep, goats, cow and/or other similar animals.

    (b)

    A fee of twenty-five dollars ($25.00) per head; plus five dollars ($5.00) board fee per head, plus any miscellaneous expenses. In addition to these fees, the owner shall be required to pay for any veterinary or drug fees incurred for his animal(s), fowl, or livestock, while they are in the custody of the city. The owner of any livestock impounded as aforesaid, may reclaim the same by providing proof of ownership and paying all expenses including board fees, impounding fees, the miscellaneous expenses, and cost of advertising. Notice, giving description of livestock will be run in a local newspaper for two (2) weeks (two (2) times). Livestock are then (if not claimed) to be sold at local sale and the proceeds from that sale to be first applied to the expense of the sale, then to expense of impounding and keeping the livestock, and the remainder, if any, to be turned over to the treasury of the city, and credited to the general fund.

    (c)

    The city council shall select and establish a suitable animal reclaim center for impounding all fowl, livestock, and wildlife by the animal control department.

    (d)

    No owner of any dead livestock shall fail to lawfully dispose of such with twenty-four (24) hours of its discovery by the owner. There is hereby established a fee of twenty-five dollars ($25.00) for each requested collection and disposal of each dead livestock [sic] within the city, and a fee of five dollars ($5.00) per trip for each requested collection of small animals, including dogs and cats. This fee shall be paid either directly to the city or to the collecting contractor for remittance to the city.
