§ 4-41. Redemption rights; disposal of unredeemed dogs and cats.
(a)
Fees. The owner of any dog or cat impounded in accordance with this article shall have the right to redeem the same upon payment to the city accounting department fees in accordance with the following fee schedule:
(1)
Impounding, first offense, thirty dollars ($30.00);
(2)
Impounding, second offense, fifty dollars ($50.00);
(3)
Impounding, third offense, one hundred dollars ($100.00);
(4)
Cost of feeding per day, five dollars ($5.00).
These fees are applicable for impounding the same animal within a twelve (12) month period. In addition to the foregoing fees, the owner shall reimburse the city for any amount paid or to be paid by the city to any doctor of veterinary medicine who administered rabies vaccination to the animal subject to any section of this article.
(b)
Redemption period. It shall be the duty of the animal control officer to keep all dogs for a period of three (3) days. All such dogs not redeemed within such time shall be destroyed, or adopted; provided, however, that, should a dog be destroyed, it shall be the duty of the city animal control officer or his appointed agents to supervise such destruction. All dogs and cats so destroyed shall be destroyed by injection of a lethal drug or other humane methods.
(c)
Public nuisance a violation of chapter. Any animal, fowl, livestock or wildlife which creates a public nuisance (see definition) is a violation of this chapter and is subject to impoundment and citation.
(d)
Citation as notice of violation. Any and all animals, fowl, livestock at-large are subject to impoundment. In addition to, or in lieu of, impounding an animal, fowl, or livestock at-large, an animal control officer or his duly appointed assistants, may issue to the known owner of such at-large animals, fowl, or livestock a citation which will constitute a notice of violation. The citation shall be forwarded to the city judge for prosecution.
(e)
Private property; right to enter. In the event an animal, fowl, livestock or wildlife is observed at-large on private property, the animal control officer and duly appointed assistants may enter the property in accordance with applicable law for the purpose of emergency impoundment, seizure of said animal, fowl, livestock or wildlife or issuance of a citation or both.
