§ 9-3. Setting fire to household furnishing, etc.

  • (a)

    For the purpose of this section, the term "fire" shall mean a hostile fire which is not confined to a place intended for the confinement of a fire, or which has escaped from such place of confinement.

    (b)

    It shall be unlawful for and an offense for any person in any hotel, roominghouse, lodginghouse, apartment facility, or similar place of abode, by any means whatsoever through carelessness or neglect, to set fire to, or cause the burning of, any bedding, furniture, rug, curtains, drapes, or other household furnishing, or any other part of such hotel, roominghouse, apartment house, tenant house, convalescent home, hospital, child care facility or similar place of abode, in such manner as to endanger the safety of any person or property.

    (c)

    The owner, manager or person in control of each hotel, roominghouse, apartment house, lodginghouse, convalescent home, hospital, child care facility or other place of abode shall post or cause to be posted, conspicuously in the lobby of each such establishment, a printed notice with the wording "Fire Regulations" in not less than fourteen-point boldface type, and the type of this section, in not less than nine-point boldface type, and shall also post such notice, or cause such notice to be posted, in each unit of occupancy within such establishment, designated or intended for the use of, or by, transients, and such locations as may be directed by the fire marshal.

    (d)

    Whenever a fire occurs in any building of any kind, except a private residence, as defined by the fire code of the city, it shall be the duty of the owner, manager, or person in control of such building, upon discovery of a fire or evidence of there having been a fire, even though it has apparently been extinguished, immediately to cause such fire, circumstances of same and the location thereof to be given to the fire department, this requirement shall not be construed to forbid the owner, manager or person in control of the mentioned building from using all diligence to extinguish such fire prior to the arrival of the fire department.
